Experience
As a Quantity Surveyor for 17 years I oversaw projects with a total value in excess of €600m. I was constantly involved in negotiating final accounts and resolving disputes that arose thereunder; these disputes varied from standard final account negotiation to full referrals to conciliator and/or arbitration. Some of the more sizable projects which I oversaw would be the refurbishment of CHQ (formerly Stack A) c.€38m, the construction of the new State Agricultural Laboratories in Backweston c.€110m and the construction of the Coliemore Apartments and Kish Restaurant c.€9m. For the past 7 years I have specialised in dispute resolution - preparing and defending claims on behalf of clients, main contractors and sub-contractors. I have prepared everything from simple final account claims to complex delay and/or disruption claims (approximately 40 disputes in the period). I am now a practicing Barrister specialising in construction, property and commercial disputes. A selection of the disputes is outlined below. I am very familiar with the Public Works, GDLA, RIAI, CIF, FIDIC and JCT forms of contract, and all the dispute provisions thereunder, having been involved in disputes under all of these.
Dispute Selection Summary
Representing public sector employer at conciliation >€10m This dispute arose between a public sector employer and main contractor under the old GDLA contract. I advised the client on all aspects of the defence, prepared the submissions and represented the employer at conciliation.
Representing property owner in Commercial Court >€10m This dispute is on-going and includes construction matters. I am advising the property owner on all matters. I am not at liberty to comment further.
Representing public sector employer at conciliation €1m-€10m This dispute arose between a public sector employer and main contractor under the PWC form of contract. I worked with lead counsel and assisted in preparing the replying submissions and presented these on behalf the public employer.
Chairperson in arbitration between private parties €1m- €10m This dispute arose between private parties under a fire insurance policy. It was a mix of construction related claims, product damage and business interruption. I conducted the arbitration process up to and including the hearing.
Representing investor in High Court €1m- €10m This dispute is on-going and involves planning matters. I am representing the investor on all matters. I am not at liberty to comment further.
Representing land purchaser in High Court €1m-€10m This dispute is ongoing and involves planning and contract matters. I am advising the purchaser on all matters. I am not at liberty to comment further.
Representing main contractor in conciliation <€1m This dispute arose between a main contractor and private client in relation to a refurbishment project on a large city centre project. I advised the main contractor on all matters, prepared the submissions and represented the main contractor at a conciliation.
Representing home purchaser in High Court <€1m This dispute arose between a house purchaser, the developer and the design team. I prepared the expert report in relation to all matters arising. I subsequently passed this over due to my new position as a barrister.
Representing subcontractor in High Court <€1m This dispute arose between a sub-contractor and main contractor. I advised the client on all matters up to and including settlement of the matter.
Representing main contractor in Conciliation <€1m This dispute arose between a main contractor and employer under the RIAI contract. I advised the main contractor on all matters, prepared submissions and represented the main contractor at a conciliation.
Representing main contractor in Circuit Court <€1m This dispute arose between a main contractor and a sub contractor on a supply and install contract. I advised the main contractor on all matters up to and including settlement of the matter.
Representing apartment purchasers in Circuit Court <€1m These disputes (10 in total) arise out of defective works in apartments. I am advising the owners on all matters. These disputes are ongoing. I am not at liberty to comment further.
Representing public sector employer in Circuit Court as 3rd party <€1m This dispute arose between a main contractor as defendant and the public sector employer as a third party. I advised the public sector employer on all matters up to and including settlement of the matter.
Representing client in District Court <€1m This dispute arose between a consultant architect and the client. I represented the client in the District Court where the matter went to full hearing. Consultant at conciliation <€1m This dispute is on-going on a matter of consultant services on a construction project. I am advising the consultant on all matters. I am not at liberty to comment further.
